What is a Mortgage Capacity Report?
A Mortgage Capacity Report is a professionally prepared document that outlines how much you may be able to borrow for a mortgage based on your income, outgoings, and financial situation.
Reports are commonly used in divorce proceedings, legal disputes, or financial planning where proof of borrowing ability is required by a solicitor or court.
Prepared by a qualified and FCA regulated Mortgage Advisor, a Mortgage Capacity Report provides a realistic assessment of your mortgage borrowing capacity from a lender’s perspective.
It takes into account not only your income but also your credit commitments, dependants, and commited living costs, offering an accurate snapshot of your Mortgage Capacity in the eyes of Mortgage Lenders.
When you may need a Mortgage Capacity Report?
There are several reasons why someone in the UK might require a Mortgage Capacity Report, including:
-
Divorce or separation proceedings
When going through a divorce, the court may request a Mortgage Capacity Report to understand whether either party can afford to purchase or refinance a home independently. -
Family court proceedings
In cases involving children, a report can help the court assess financial stability and housing options. -
Financial planning during major life changes
If you’re restructuring finances due to changes in employment, income, or dependents, a report can assist in making informed decisions. -
Property settlement disputes
If property ownership is under question, a Mortgage Capacity Report can demonstrate one’s ability to buy out a partner or take on a new mortgage.
Solicitors and family law professionals often recommend these reports to support legal arguments with factual financial data.
What is included in a Mortgage Capacity Report?
A comprehensive Mortgage Capacity Report typically includes:
-
Detailed analysis of your income, including salary, bonuses, pensions, benefits, and any additional income streams.
-
A review of your monthly outgoings, including rent or mortgage payments, credit cards, loans, and other financial obligations.
-
Your credit history and how it affects your mortgage potential.
-
A breakdown of affordability calculations using real-time lending criteria from multiple UK mortgage lenders.
-
A comparison of potential borrowing amounts from different lenders.
-
A formal, professionally written report suitable for presentation in court or submission to a solicitor.
The report is not a mortgage offer but gives a realistic picture of what you could borrow in today’s lending environment.
Who prepares a Mortgage Capacity Report?
Only qualified and regulated Mortgage Advisors and Financial Advisors should prepare a Mortgage Capacity Report. In the UK, this usually means Advisors who are FCA-regulated and have access to the current criteria and lending policies from a range of mortgage providers.
I am personally fully CeMAP-qualified and highly experienced in producing court-compliant reports that reflects Lenders affordability and lending criteria.
We work directly with solicitors and clients to ensure every report is accurate, up-to-date, and tailored to the individual’s financial circumstances.
How does a Mortgage Capacity Report differ to a Mortgage in Principle?
A Mortgage Capacity Report is often confused with a Mortgage in Principle (MIP), but they serve different purposes:
-
A Mortgage in Principle is a certificate from one Mortgage Lender showing how much you might be able to borrow, usually based on self-declared information and your credit profile: more info
-
A Mortgage Capacity Report, on the other hand Mortgage Capacity Reports are more detailed and produced by Mortgage Advisors specifically designed for the courts and provides context on what you can borrow based on the whole market. It includes deeper analysis and takes Mortgage Lender Criteria, affordability models, and verified documents into account: more info
In legal situations, an MIP is typically not sufficient. Courts and Solicitors often require the more detailed and impartial Mortgage Capacity Report instead.

Frequently Asked Questions
What is a Mortgage in Principle?
You may hear it called a Mortgage, Agreement or Decision in Principle (MIP, AIP or DIP). But they are all the same thing:
An initial application to the best Mortgage Lender for your circumstances, in which the Lender will determine how much you are able to borrow and whether you initially meet their Criteria.
During which, the Lender will complete a credit check on you and will consider your income and outgoings.
Most estate agents will want confirmation from your Mortgage Broker of your Mortgage in Principle prior to you viewing or offering on a property.
Can I get a Mortgage Capacity Report if I have Bad Credit?
Yes you can, but it may have an impact.
If you would like the Advisor to consider your Credit profile, as this may affect your ability to obtain a Mortgage, please provide the Mortgage Advisor with a copy of your full Credit Report so this can be considered alongside the other information you provide your Advisor with.
Can I get a Mortgage Capacity Report if I'm Self Employed?
Yes, you will typically need at least 1 years worth of accounts.
